These Terms of Service (“Terms”) govern your access to and use of the Gr8 Escapes Booking App (“App”), the TravelPass traveller companion, and the Messenger feature integrated into them, operated by CPR InsightsPH on behalf of Gr8 Escapes Travel and Tours (“Gr8 Escapes,” “we,” “our,” or “us”).

By accessing or using TravelPass, or by communicating through the Messenger feature, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you must discontinue use of these services immediately.

1. Description of Service

The Messenger feature enables users to:

Submit travel inquiries;
Request quotations and itineraries;
Receive travel information and promotional offers;
Communicate with Gr8 Escapes representatives;
Submit travel documents and booking requirements;
Receive booking updates, reminders, and customer support.

Certain functionalities may be facilitated through automated systems, chatbots, or artificial intelligence technologies.

TravelPass

TravelPass is issued to travellers on a confirmed booking and is reached through a private link provided by Gr8 Escapes. It enables a traveller to:

View the itinerary, schedule, and arrangements for their trip;
Access travel documents, vouchers, and confirmations, including while offline;
Reach the guides, drivers, and coordinators assigned to their trip;
Record photographs and notes from the journey;
Optionally sign in with Google to secure the pass to themselves.

TravelPass is not offered for public registration or sale. It is provided as part of a booking arranged with Gr8 Escapes, and access is limited to the travellers recorded on that booking. Signing in with Google establishes identity only; it does not by itself confer access to any booking.

Information presented in TravelPass reflects arrangements as recorded at the time of viewing. Schedules, suppliers, and conditions may change during travel, and TravelPass is not a substitute for confirmations issued by carriers, hotels, or other suppliers.

2. Eligibility

You represent and warrant that:

You are at least eighteen (18) years of age; or
You are using the service under the supervision or consent of a parent or legal guardian;
You possess the legal capacity to enter into binding agreements.

We reserve the right to refuse service, suspend access, or terminate communications if eligibility requirements are not met.

3. User Responsibilities

You agree to:

Provide accurate, complete, and truthful information;
Keep your contact and travel information updated;
Ensure that all documents submitted are authentic and valid;
Maintain the confidentiality of any booking reference numbers or account credentials provided to you;
Use the Messenger feature only for lawful purposes.

You shall be solely responsible for all information and content you submit.

4. Prohibited Conduct

Users shall not:

Submit false, misleading, or fraudulent information;
Impersonate another individual or entity;
Upload malicious software, viruses, or harmful code;
Use abusive, defamatory, obscene, or threatening language;
Interfere with the operation or security of the Messenger feature;
Use automated tools, bots, scripts, or scraping technologies without authorization;
Attempt unauthorized access to our systems, databases, or accounts;
Engage in activities that violate applicable laws and regulations.

Violation of this provision may result in immediate suspension or termination of access and may expose the user to civil and criminal liability.

5. Quotations and Pricing

All quotations, fares, prices, itineraries, and travel packages provided through Messenger:

Are subject to availability;
May change without prior notice;
Do not constitute a confirmed booking unless expressly confirmed in writing by authorized Gr8 Escapes personnel;
Are subject to airline, hotel, supplier, government, and foreign exchange adjustments.

A quotation generated through Messenger shall not create a binding contract unless accepted and confirmed in accordance with Gr8 Escapes booking procedures.

6. Booking Confirmation

A booking shall only be deemed confirmed upon:

Submission of complete passenger details;
Compliance with documentary requirements;
Receipt and verification of the required payment;
Written confirmation issued by Gr8 Escapes.

Submission of inquiries or requests through Messenger alone does not guarantee reservation or availability.

7. Payments

All payments shall be subject to the official payment policies of Gr8 Escapes.

Users acknowledge that:

Reservation fees and deposits may be non-refundable;
Full payment deadlines must be strictly observed;
Failure to pay within prescribed periods may result in automatic cancellation;
Additional supplier-imposed charges, taxes, penalties, or fees may apply.

Payment instructions shall only be considered valid if issued through official Gr8 Escapes channels.

8. Artificial Intelligence and Automated Responses

The Messenger feature may utilize artificial intelligence, automated messaging systems, or chatbots.

You acknowledge and agree that:

Automated responses are intended for informational and customer support purposes;
AI-generated responses may occasionally contain inaccuracies or incomplete information;
Final travel arrangements, prices, and confirmations remain subject to human review and verification.

Gr8 Escapes shall not be liable for decisions made solely in reliance upon automated responses.

9. User Content

You retain ownership of documents, images, messages, and other materials you submit.

By submitting content through Messenger, you grant Gr8 Escapes and CPR InsightsPH a non-exclusive, royalty-free, worldwide license to use, reproduce, process, store, and transmit such content solely for purposes related to:

Booking administration;
Customer support;
Service improvement;
Legal and regulatory compliance.

You warrant that you possess all rights necessary to submit such content.

10. Intellectual Property

All software, systems, trademarks, trade names, logos, designs, content, and proprietary technologies associated with the Messenger feature are owned by or licensed to CPR InsightsPH and/or Gr8 Escapes.

Nothing in these Terms shall be construed as transferring any intellectual property rights to users.

Users may not copy, modify, distribute, reverse engineer, or exploit any part of the Messenger feature without prior written consent.

11. Privacy

Your use of the Messenger feature is likewise governed by the applicable Privacy Policy.

By using the Messenger feature, you consent to the collection, processing, storage, and disclosure of personal information in accordance with such Privacy Policy and applicable data privacy laws, including the Philippine Data Privacy Act of 2012.

12. Third-Party Services

These services operate through platforms and services provided by third parties, including but not limited to:

Meta Platforms, Inc.;
Facebook Messenger;
Google LLC, where you choose to sign in with Google;
Cloud hosting providers;
Payment processors;
Travel suppliers.

We are not responsible for interruptions, errors, security incidents, or actions attributable to third-party providers.

Use of third-party platforms shall likewise be subject to their respective terms and policies.

13. Disclaimer of Warranties

The Messenger feature is provided on an “AS IS” and “AS AVAILABLE” basis.

To the fullest extent permitted by law, Gr8 Escapes and CPR InsightsPH disclaim all warranties, whether express or implied, including warranties of:

Merchantability;
Fitness for a particular purpose;
Accuracy;
Reliability;
Availability;
Non-infringement.

We do not guarantee uninterrupted, secure, error-free, or continuous operation of the Messenger feature.

14. Limitation of Liability

To the maximum extent permitted by law, Gr8 Escapes, CPR InsightsPH, their officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to:

Use or inability to use the Messenger feature;
Delays, interruptions, or system failures;
Errors or omissions in automated responses;
Loss of data or communications;
Third-party acts or omissions;
Supplier cancellations, schedule changes, or force majeure events.

In no event shall our aggregate liability exceed the amount actually paid by the user for the specific transaction giving rise to the claim.

15. Indemnification

You agree to indemnify, defend, and hold harmless Gr8 Escapes, CPR InsightsPH, and their officers, employees, agents, and affiliates from any claims, losses, damages, liabilities, costs, or expenses arising from:

Your breach of these Terms;
Your misuse of the Messenger feature;
Your violation of any law or third-party rights;
Information or content submitted by you.

16. Suspension and Termination

We reserve the right, at our sole discretion, to suspend, restrict, or terminate access to the Messenger feature at any time, with or without notice, if:

You violate these Terms;
Fraudulent or unlawful activity is suspected;
Security concerns arise;
Continued access may expose us or other users to risk.

17. Force Majeure

Neither party shall be liable for delays or failures resulting from causes beyond reasonable control, including but not limited to:

Natural disasters;
Pandemics;
Government actions;
War or civil unrest;
Internet or telecommunications failures;
Supplier disruptions;
Acts of God.

18. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.

Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the proper courts located in Pangasinan, Philippines, unless otherwise required by applicable law.

19. Amendments

We reserve the right to modify or update these Terms at any time.

Updated Terms shall become effective immediately upon posting or publication through the App or other official channels.

Continued use of the Messenger feature following such changes constitutes acceptance of the revised Terms.
